COPYRIGHT & INTELLECTUAL PROPERTY POLICY

This Copyright and Intellectual Property Policy explains the ownership, permitted use and protection of content available through www.deshaatan.com and other Deshaatan platforms.
For this Policy, "Deshaatan", "we", "us" or "our" refers to Aurven Travel Commerce India Private Limited.
1. DESHAATAN CONTENT
The Deshaatan Platform may include destination guides, articles, travel recommendations, itineraries, itinerary structures, cost guides, destination comparisons, package descriptions, activity descriptions, specialist-authored content, Planning Tools, maps, photographs, videos, illustrations, graphics, icons, logos, designs, databases, reviews, page layouts, software, metadata and other written, visual or digital material.
Content may be created and owned by Deshaatan, licensed to Deshaatan, supplied by Travel Partners, supplied by users, or used under another lawful basis.
The applicable intellectual-property rights remain with the relevant rights holder.
2. OWNERSHIP OF ORIGINAL DESHAATAN CONTENT
Unless otherwise stated, original content created by Deshaatan is owned by Aurven Travel Commerce India Private Limited and protected by applicable copyright, trademark and other intellectual-property laws.
Users may access such content for personal and non-commercial travel-planning purposes.
3. PROHIBITED USES
Without prior written permission, you may not:
reproduce substantial portions of Deshaatan content;
republish our articles, destination guides, itineraries or cost guides;
copy our original package descriptions for commercial use;
systematically scrape our Platform;
use Deshaatan content to train, fine-tune or build artificial intelligence or machine learning models, or for text and data mining;
create a database using substantial portions of our content;
sell or sublicense our content;
remove ownership or copyright notices;
falsely claim Deshaatan content as your own;
use Deshaatan content to impersonate or misrepresent an association with us; or
reproduce Deshaatan branding in a manner likely to cause confusion.
Normal sharing of links to publicly accessible Deshaatan pages is permitted and encouraged.
Limited quotations may be used where permitted by applicable law and accompanied by appropriate attribution and a link to the original page.
4. DESHAATAN NAME, LOGO AND TRADEMARKS
The name Deshaatan, its logos, visual identity, taglines (including "Discover better. Plan smarter. Travel confidently.") and other brand identifiers may constitute trademarks or proprietary brand assets of Aurven Travel Commerce India Private Limited.
Nothing on the Platform grants a licence to use Deshaatan branding without prior written permission.
Third-party trademarks appearing on the Platform remain the property of their respective owners.
5. TRAVEL PARTNER CONTENT
Hotels, homestays, tour operators, activity providers, photographers, guides and other Travel Partners may provide Deshaatan with property descriptions, photographs, videos, itineraries, activity details, brochures, logos or other content.
By providing such material, the Travel Partner represents that it owns the content, or has sufficient permission or licence to supply it to Deshaatan and authorise its intended use.
Travel Partners must not knowingly submit material that infringes the intellectual-property rights of another person.
6. LICENCE FOR PARTNER CONTENT
Unless agreed otherwise in writing, a Travel Partner supplying content for display or promotion grants Deshaatan a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, resize, adapt for technical presentation, distribute and promote that content for purposes connected with Deshaatan's Platform, travel products, advertising and marketing.
Ownership of the underlying material remains with the relevant rights holder unless expressly transferred under a separate written agreement.
7. ACCURACY OF PARTNER CONTENT
Travel Partners are responsible for ensuring that material supplied to Deshaatan accurately represents the relevant property, activity or service.
Images or descriptions must not create a materially misleading impression of the service being offered. Outdated photographs, heavily edited images or images of a different property or room category must not be presented as current.
Deshaatan may edit, reject or remove material that is inaccurate, misleading, low quality or potentially infringing.
8. USER-SUBMITTED CONTENT
Users may submit reviews, comments, photographs, videos, travel stories or other content.
By submitting content, you represent that:
you created it or have permission to submit it;
where it shows identifiable individuals, you have their consent;
it does not infringe copyright, trademark, privacy or other rights;
it is lawful; and
you have authority to grant the licence described below.
You retain ownership of your original User Content.
9. LICENCE FOR USER CONTENT
By submitting User Content to Deshaatan, you grant Deshaatan a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, resize, format, publish, distribute and use the content for operating, promoting and improving Deshaatan and its travel services.
Where we feature your photographs or stories, we will try to credit you where practical. Where legally required, attribution and other moral rights will be respected in accordance with applicable law.
You may request removal of your published content at any time by writing to care@deshaatan.com. We will remove it from the Platform within a reasonable time, although copies already used in printed or previously published materials may not be recoverable.
10. PHOTOGRAPHS AND VIDEOS
Photographs and videos displayed on Deshaatan may be created or commissioned by Deshaatan, licensed from photographers or media libraries, provided by Travel Partners, provided by travellers, or otherwise lawfully sourced.
The presence of an image on Deshaatan does not mean that the image is free for reuse. Users wishing to use a particular image commercially should contact us to determine the applicable rights.
11. STOCK, LICENSED, GENERATED AND AI-ASSISTED MEDIA
Where Deshaatan or a contributor uses stock, licensed, generated or AI-assisted media, such material must be used consistently with applicable licences, contractual restrictions and law.
AI-generated, digitally reconstructed or substantially manipulated visual content must not be presented in a manner that materially misleads travellers about the actual appearance, facilities, condition or experience of a destination, hotel, room, attraction, activity or other travel service.
Where AI-generated or substantially edited imagery could reasonably be mistaken for an actual photograph of a travel service or destination, Deshaatan will use an appropriate disclosure or contextual label.
AI-assisted creation or editing does not override the intellectual-property rights of photographers, artists, brands or other rights holders.
Contributors and Travel Partners must not provide material to Deshaatan while falsely representing that they own, created or hold exclusive rights to material belonging to another party.
12. REPORTING COPYRIGHT INFRINGEMENT
Deshaatan respects intellectual-property rights. If you believe material appearing on Deshaatan infringes copyright that you own or are authorised to represent, please send a complaint containing:
your full name and contact information;
identification of the copyrighted work;
the exact Deshaatan URL containing the allegedly infringing material;
identification of the specific material complained of;
evidence reasonably demonstrating ownership or authority to act for the owner;
a statement explaining why you believe the use is unauthorised; and
a declaration that the information supplied in your complaint is accurate to the best of your knowledge.
